A 35 year old man of Kasama district, has been fined K6000 for manslaughter for causing the death of a six year old child

Zambia: A 35 year old man of Kasama district, has been fined K6000 for manslaughter for causing the death of a six year old child. The suspect has been identified as Tailos Banda and the investigation into the incident has been going on.

The six year old victim of the incident has also been identified by the Police force as Misheck Mulenga Mukuka. The victim died as a result of an accident when the suspect was reversing his car in a residential area.

The matter has been taken to the court after the Police force of the Kasama district arrested the 35 year old for manslaughter. The court has ruled that his offense is contrary to section 199 of the penal code, chapter 87 of the laws of Zambia.

According to the Court, Banda had pleaded guilty to the offence before Kasama High Court Judge Matthews Zulu in Kasama. The Police force, who have been investigating the incident gave shared some details of the accident with the court.

According to the Police, on January 2, 2022, Banda caused the death of the boy when he was driving in reverse at a residential area. The victim was seriously injured as a result of the hit and run accident. He allegedly succumbed to injuries sustained shortly after he was hit.

In mitigation, Banda’s lawyer asked the court to exercise leniency while giving him a sentence. He noted that his clients had shown remorse after the accident. He also reminded the court of justice that he had no previous criminal record.

Banda also covered all funeral expenses and contributed K7000 while his insurance company covered an amount of K25,000.

In passing sentence Justice Zulu noted that while the offence was serious and that Banda’s plea of guilty and the role he played at the funeral and the show of remorse were taken into account.

He fined Banda K6000, in default of which he will serve six months simple imprisonment.
