Zambia: The judicial courts of Zambia have convicted a former employee of the National Pension Scheme Authority (NAPSA) on the counts of fraud. Accounts Clerk Stark Simbaya was allegedly involved in a fraud involving over K2 million.
The convict has been sentenced to two years imprisonment with hard labour. The Anti Corruption Commission of Zambia was involved in the arrest and imprisonment of Simbaya. The ACC arrested the victim in 2017, when his fraudulent activities came to light.
The Anti Corruption Commission of Zambia has been working diligently to root out all forms of corruption in the government sector employment. Many public sector employees have allegedly been arrested on the counts of various frauds and accounting negligience.
The commission has made many high profile arrests public with the aim of discouraging people from indulging in these activities
According to the Solwezi Subordinate Court Magistrate Davies Chibwili Simbaya was found guilty of fraudulent False accounting. He altered false documents contrary to Sections 326 and 352 of the Penal Chapter 87 of the Laws of Zambia.
Anti-Corruption Commission (ACC) Head of Corporate Communications Timothy Moono stated that Simbaya was arrested by the Commission in 2017. At the time of his initial arrest, he was charged with 31 counts of fraudulent false accounting and three counts of altering of False Documents.
Moono further disclosed that the convict purported that three companies made their NAPSA monthly contributions when they did not.
He added that Simbaya alleged to have knowingly and fraudulently uttered false documents namely NAPSA Employer Statements in the name of the said companies.
“Brief facts of the offence are that between June 1st 2016 and May 31st 2017, Simbaya made Fraudulent False Accounting by purporting that three companies namely Freca Mining, Buildcon and Silondwa Engineering Works Limited had paid the NAPSA monthly contributions when in fact not,” said Mr Moono.
He noted that in passing the sentence, Magistrate Chibwili also ordered and directed that the sentence run concurrently on each count with effect from December 18th, 2023.
