Lusaka: A 44-year-old Businessman of Lusaka in the Kabanana area, identified as Richard Mwanza has pleaded not guilty of defiling six minors. The defendant was accused of raping six children under the age of 16, after which he sought legal aid
As per the investigating officers, the incidents involving the minors took place on unknown dates between January 2023 and November 25, 2023. The defendant denied the accusations when the
charges were read to him by Lusaka Resident Magistrate Chrispine Hampungani.
The defendant, Richard Mwanza pleaded not guilty in front of the court. Afterwards, the defendant asked the court if he can be granted bail. The reason for the demand was to ensure that he could look for a lawyer but the state objected to his request.
Magistrate Hampungani, who rejected the accused’s application reasoned that he is safer in custody than being out in the community. The court believes that the defendant can ask his family or relatives to arrange for a lawyer.
“Looking at the docket that we have and the offence he is charged with, the proximity between him and the victims is in close proximity, the state feels that for his own safety and protection, it would be good for him to be in custody, even where he is, he can get help from relatives and get a lawyer. We, therefore, retaliate and object to the application.” The statement of the court said on the matter.
The offence is Contrary to Section 138 Clause 1 of the Penal Code Chapter 87 of the Laws of Zambia.
Magistrate Hampungani has adjourned the matter to February 22, 2024 for commencement of trial. The case is officially in the court and the defendant has almost thirty days to arrange for legal representation.
The people of the country have expressed their anger on the alleged act of the defendant. They have called on the legal system to be just and make sure that the wrongdoing is appropriately addressed.
